They were not required to have a refund policy, they just couldn't have a policy of "no refunds." and they got fined for that. The current refund policy didn't happen because of Australia.

GoG.com has a refund policy, and they don't have a blanket statement of "No Refunds", therefore they can't be sued like Valve was.
