Who knew you could make a killing selling punctuation marks? A company in the US will sell you a punctuation mark that can display hints of sarcasm.
I'm serious. Seriously serious. $2 for a sarcasm mark. There's also the commercial which involves a guy with a Spandex costume.
Saw that on the SA forums and yes, they DO use the SarcMark and NO you can't copy the damn image...at least not to my knowledge anyways :D.
I don't think you can patent punctuation. You can copyright a logo or an image, but in order to qualify as punctuation, I think a symbol has to be freely available. Frankly, I don't see this catching on.
Half tempted to make a bunch of little character squiggles for other emotes/attitudes, capitalise on it before other people do...
I predict that this will be as successful as the irony mark: ؟

No, but the thing about American laws is that they work only in the US. Well, most of the time, anyway.
Basically, I think more nuanced punctuation is an excellent idea, and it certainly could catch on, but not as long as someone is trying to cash in on it. If the marks in question were simply added to the various official character sets (as defined by whoever does these things. ISO? ANSI? W3C?) then I'm sure people would start using them.
I still prefer the interrobang. That one's at least remotely useful.

why not just use <sarcasm> </sarcasm> like a normal nerd with more html experience than social skills?
Besides, who the fuck is going to teach everyone what this squiggly thing means so they don't assume its some broken character and ignore it? More importantly do you have to install it in order to be made aware of sarcasm or will you be living in blissful ignorance with an extra 2 bucks in your wallet?
Deaf people can see "Sarcastic: Thats a good idea" if people who make subtitles bother to do things like that but when they can't be fucked to get the WORDS right half the time then I doubt the feeling behind the words is going to get much love
