As long as it's clear who owns the IP (which it is in case of Tomb Raider), there's nothing gray about it, the matter is actual very clear-cut. Either you do it with the explicit permission of the IP holder (legal) or you do it without (not legal).

Many IP holders tolerate third-party remakes as long as they aren't commercial products. There's good reason for doing so - after all, such a project is free advertising for your IP, and you can use its success to gauge the viability of potential "official" remakes in the future.

But as soon as an IP holder decides to _not_ tolerate a given project, it has to go down (or continue in the shadows), the IP holder's rights aren't questionable in this regard.

Psyringe: Seconded. I'm desperately trying to unremember it since it was posted. Diversion, meditation, and reciting the first 200 digits of Pi all proved unsuccessful. I'm currently considering to drink myself into a blackout, but that would involve organizing booze. Also, I hate the taste of any alcohol other than advocaat. Any suggestions?

Only if you do it without the permission of the license holder. Some fan remakes actually did got "a fan license" to make the remakes and distribute them for free. But other than that, the license holder has the right to shut down any fan project if they think it violates their rights

I was helping my dad clean out his old place a couple days ago, and we came upon this bottle of stuff that we couldn't identify that he's pretty sure he got last time he went to Mexico. Anyways, in your post you mentioned advocaat and I didn't know what it was so I checked out the wikipedia page. Under the related drinks category it mentioned rompope which is apparently a drink from mexico/central america.

The contents of the bottle were a custard-y like yellow, so it just clicked into place.

Since there is currently no such kickstarter to begin with, this question is kinda hard to answer. ;)
If someone ever tries to kickstart a 3D game with tank controls like Tomb Raider I think they'll have a bad surprise...

I think "beg for a remake" KS project would be against the rules of KS, as the project can't provide a product no matter how much they'd make, as Sueenix wouldn't be resposible of a such projects fullfillment. Also it might cause Sqeenix to take action against such KS, as it might cause larger public to see Sqeenix in a bad light, as many people would be asking "why is a big company begging moolah in KS?"
