I can't believe how many posters support Activision around here. The corporate bully Activision has turned into is quite disgusting tbh. And as for EA they seem to show more respect to both their customers and their devs(at least the successful ones) these days. In any case i doubt Activision stand a chance in court with this.

It's bloody obvious that no one has been told the full truth about what has gone on at IW. On one hand you have the guys saying Activision sacked them to avoid paying them what they are legally owed and that Activision sent in 'bouncers' to clamp down the whole office. Seems a bit extreme unless Activision were worried they were taking something to a competitor. While the guys are saying they are innocent Activision claim they were in talks to jump to a fierce competitor (which could only mean EA) and lo and behold they wasted no time announcing this publishing deal with EA.
Two things can happen now. We will have to wait until they go to court and we find the truth out or Activision will settle out of court. I would imagine for all the posturing and mum cussing the latter is more likely.

Activision own Modern Warfare. The only reason it is being claimed as a part of the suit against Activision is because of the unpaid royalties. I don't think they honestly believe they stand a chance of getting the MW name. They probably think they can just scare Activision into an out of court settlement.

MW3 is already in development. I highly doubt Zampella and West have enough of a case to actually bar its release. After all, they've got no legal claim over the name. More likely they'll just get the money they're owed with interest.

if it goes into courts any MW3 development will be stopped. they don't need a strong case. just enough to postpone development by 6-12 months. that will cost millions to activision.

Usually such facets of a case a thrown out fairly quickly for that reason. Take Bethesda vs Interplay as an example: Bethesda's attempt to stop Fallout 'Trilogy' sales was thrown out almost immediately, but the core case is still being pursued.

I have a feeling it was Activision rushing to keep secrets in house. But everyone is right, it will all settle out of court and it is 50-50 that IW will keep the Call of Duty brand by the end of it. I think that IW Heads asked for more money out of contract, Activision refused so the heads threatened to go to another company, Activision clamped down on IW and booted the troublemakers under threat of Lawsuit. Kicked out heads go to EA and get signed, lawsuit will be settled out of court and life will go on.
