Arkose: The original developer/publisher retains the rights to the game itself but not the licensed content (in this case being mech designs and so forth). Games are sometimes re-released with a renewed license or the affected content replaced, but most of the time they are simply never seen again. TOCA 3 and Colin McRae 2004 were removed from GOG for this reason.

Contrary to popular belief the MechCommander games are not freeware. Microsoft released the source and assets of MechCommander 2 to promote XNA development, which may be where the confusion originated, but its original CD form is not freeware nor is any version of the first game.
So do you mean Activision have the rights to "Mechwarrior 2" but they don't have rights to the mechs that appear into the game? that doesn't make any sense to me. What is the practical difference with no having the rights at all? or, to put it simply to a legal illiterate like me, are they or are they not allowed to release MW2 on their own?

That's exactly what it means. For example Activision once had the Star Trek license which allowed them to make games like Armada and Elite Force however when it came to renew that license Activision declined saying that Paramount had allowed the franchise to die and it wasn't as marketable as it was when the initital agreement was made. Consequently while Activision own Star Trek Armada and Elite Force they don't own the rights to the characters, races and ships so they are unable to re-issue the games. If Activision wanted to re-release them then they would have to come to an agreement with Paramount again and likely the new Star Trek licencess Atari. This is why it took so long to get AD&D games on GOG.

Fruit_Brute: Just the 2nd one. Skip the 1st.
That bad huh? I have both, but only played the second. I heard about the notoriety of the first many years back too in a review on CGW.

I refuse to acknowledge this recommendation. Heavy Gear 1 is brilliant.
I'd put in my vote for Starsiege. Actually, anything from the Earthsiege series would be great.

And, yeah, Heavy Gear 1 is a stinker. No bout adout it.
You should check the http://www.mechlivinglegends.net/ - it's a multiplayer Mod re-constructing the Battletech universe (inc. Mechwarrior and MechAssault series PC games) in a way like this: http://www.mechlivinglegends.net/wp-content/uploads/2011/05/mwll-050-teaser.jpg

But be aware - it's not a game for casual players. It's quite complex, though when you'll master it - it'll be the best Mech game you've ever plaid. At least: It is for me, and I've plaid nearly all PC Mech games released so far. :)

Metametheus: Im still hoping that GoG will come out with an updated version that allows me to buy a copy of Earthsiege / Earthsiege 2 that will work on Vista or Windows 7. I miss those games so mucch its almost sad. There are no good mech games anymore, those that exist are a part of a FPS or are RTS strong.

TheEnigmaticT: I loved the Earthsiege series. I'm torn between ESII and Starsiege as my favorite from the series, and Missinforce: Cyberstorm is one of the only squad-based strategy sims that I've played through more than a dozen times.
Only reason I still love ES / SS is because they are strategic survival Mech Games, i would love to see a game that uses a story plot like ES/SS, with option to move as a person like in Planetside or Dust 514, while operating with others. Hmm that would make a great MMO actually, Starsiege Universe MMO... starts getting goosebumps.
It would be quite a feat for GOG to get the first two MechWarrior games. The licensing is all over the place. Developed and published by Activision, but as Arkose mentioned, Microsoft now has the video game license. MechWarrior is based on the Battletech franchise created by FASA and now owned by Catalyst, who is owned by WizKids. IIRC, when Battletech started, they licensed some designs from Japanese companies, such as Studio Nue. However, because US copyright law is pants-on-head retarded, Harmony Gold, producers of Robotech, actually had the license for the designs, meaning FASA's licenses were pretty much null and void. Fearing legal action by Harmony Gold, FASA retired these designs (they're referred to as "Unseen", because Fasa/Catalyst can't publish art for them, though they still exist in canon) which were mostly designs for the mechs in MechWarrior 1 and their IIC variants in MechWarrior 2.

According to the BattleTech Wiki, however, many of these Mechs have become "Reseen" from recent agreements, so hopefully it will happen eventually.

I still have my old MechWarrior 2 CD, the Diamond Monster 3D edition. Its soundtrack has never left my iPhone :D
I still have MW2: Mercenaries and ES1 on CD, but I'd gladly purchase a GOG version of both titles. Also, having that the MW license seems to be a legal mess, how about EarthSiege? would it be easier to get this one on GOG?

Mechwarrior 4 is available for free (Legally) from MekTek's site.

The licensing with MS was a pain but they did manage it.
I'd love to see the Front Mission series here. They'd need emulators though.
